1. About us

This website, sovasleep.io, is run by Sova Sleep Ltd, a company registered in England and Wales (company number 17277239), with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. In these terms, "we", "us" and "our" mean Sova Sleep Ltd, and "you" means the person using our website or placing an order.

2. These terms

These terms apply when you use sovasleep.io and when you buy products from us through this website. Please read them before placing an order. By placing an order, you agree to these terms.

They should be read together with our Delivery and returns page and our Privacy policy.

If you bought a Sova product through Amazon or another retailer, your purchase is covered by that retailer's terms, although our 12-month warranty still applies.

3. Placing an order

• You must be 18 or over to place an order, or have the permission of a parent or guardian.
• After you place an order, we'll email you to confirm we've received it. This is not yet acceptance of your order.
• A contract between you and us is formed when we email you to confirm your order has been dispatched.
• We may decline or cancel an order before dispatch, for example if a product is out of stock, if there is an obvious error in the price or description, or if we suspect fraud. If this happens, we'll tell you and refund any payment in full.

4. Prices and payment

• All prices are shown in pounds sterling (GBP). Sova Sleep Ltd is not currently registered for VAT, so no VAT is charged on our prices.
• Delivery charges, if any, are shown at checkout before you pay. Standard UK delivery is free.
• We accept debit and credit cards, Apple Pay, Google Pay and Klarna. Payments are processed securely by Stripe, and we never see or store your full card details.
• If you choose Klarna, your payment arrangement is with Klarna and is subject to Klarna's own terms, which you'll be shown before you confirm. Klarna may carry out a credit check.
• We try hard to make sure prices are correct. If we find an obvious pricing error after you've ordered, we'll contact you and give you the choice of continuing at the correct price or cancelling for a full refund.

5. Discount codes

• Only one discount code can be used per order.
• Our welcome code for newsletter subscribers can be used once per customer.
• Unless stated otherwise, discount codes can be used on sale prices.
• Discount codes have no cash value, can't be exchanged for cash and can't be applied to orders that have already been placed.
• We may change or withdraw a discount code at any time, and may cancel orders where a code has been misused.

6. Delivery

We deliver to UK addresses only. Delivery options, costs and times are set out on our Delivery and returns page and at checkout. Responsibility for the products passes to you once they are delivered to the address you gave us.

7. Returns, refunds and warranty

You can return your Sova Drift within 30 days of delivery under our money-back guarantee, and it comes with a 12-month warranty against faults. Full details, including how to return an item and how refunds work, are on our Delivery and returns page.

These do not affect your legal rights, including your right to cancel an online order within 14 days of delivery under the Consumer Contracts Regulations 2013, and your rights under the Consumer Rights Act 2015 if goods are faulty or not as described.

8. Using Sova Drift safely

Please read and follow the instructions supplied with your product. In particular:

• Keep the volume at a comfortable, moderate level. Listening at high volume for long periods can damage your hearing.
• Do not use the earbuds while driving, cycling or in any situation where you need to hear your surroundings.
• Make sure you can still hear alarms, such as smoke alarms and alarm clocks, at the volume you use while sleeping.
• Stop using the earbuds if they cause discomfort, pain or irritation, and keep the ear tips clean.
• Keep small parts away from young children.

Sova Drift is a consumer audio product. It is not a medical device and is not intended to diagnose, treat or prevent any sleep disorder or medical condition. If you have ongoing sleep problems, please speak to a healthcare professional.

9. Product descriptions

We take care to describe and show our products accurately. Colours may look slightly different depending on your screen, and battery life figures are typical results that vary with volume, settings and use.

10. Sova Soundscape

Sova Soundscape is a free web app for playing sleep sounds. You may use it for your own personal, non-commercial use. You may not copy, download, redistribute or sell the audio or any part of the app.

We provide Sova Soundscape as it is and may change, pause or withdraw it at any time. We don't guarantee it will always be available or free from interruptions.

11. Reviews

We welcome honest reviews. By submitting a review, you confirm it reflects your genuine experience, and you allow us to display it on our website and in our marketing. We may remove reviews that are offensive, misleading, fake, unrelated to the product or that include personal information.

12. Intellectual property

All content on this website, including text, images, logos, designs and audio, belongs to Sova Sleep Ltd or our licensors. You may not copy or use it for commercial purposes without our written permission.

13. Our liability

• If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure, but we are not responsible for loss or damage that is not foreseeable.
• We supply products for domestic and private use only. We are not liable for any loss of profit, loss of business or business interruption.
• Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law, including your rights as a consumer.

14. Events outside our control

We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as courier or postal disruption, severe weather or supplier problems. If this happens, we'll let you know as soon as possible and do what we can to reduce the delay. If the delay is significant, you may cancel your order for a full refund.

15. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one shown on our website when you placed it.

16. Law and disputes

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you have a complaint, please contact us first at info@sovasleep.io and we'll do our best to resolve it quickly.
